Remember Me Forward LLC · remembermeforward.com
This is a legally binding agreement. Please read it before using the Service. Sections in bold outline the parts of RMF that are unique to how we work — the Legacy Vault, family groups, and Hub identity.

1. Acceptance of Terms

By accessing or using Remember Me Forward ("RMF," "the Service," "we," "us," or "our") at remembermeforward.com, creating an account, or using any features of the platform, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Remember Me Forward LLC is a limited liability company organized under the laws of the United States. These Terms constitute a legally binding agreement between you and Remember Me Forward LLC.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Description of the Service

Remember Me Forward is a family memory preservation and legacy platform that allows users to:

  • Create, store, and organize personal memories, photos, videos, memoirs, and life stories
  • Build and maintain interactive family trees
  • Share memories with invited family group members
  • Create a Legacy Vault containing messages, documents, and media intended for delivery to designated recipients at a future date or upon a qualifying event
  • Connect with family members and designate confirmed relationships for the purpose of Legacy Vault access
  • Record life passions, career milestones, and personal narratives

The Service is provided as a subscription-based platform. Certain features may require a paid subscription tier.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

The Service is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us at privacy@remembermeforward.com.

Family group members who are minors (ages 13–17) may access certain shared memory content only if invited by an adult account holder, and their use of the Service is subject to these Terms and the supervision of the inviting adult.

4. Accounts and Registration

4.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You agree to maintain and promptly update your account information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@remembermeforward.com of any unauthorized access or use of your account.

4.3 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited.

4.4 Hub Identity

Upon account creation, you are assigned a unique "Memory Hub" identity (selfHubId) that serves as the persistent identifier for your content and family connections within the platform. This Hub ID remains associated with your account for the duration of your use of the Service.

5. Subscriptions and Payment

5.1 Subscription Tiers

The Service is offered in multiple subscription tiers with varying features and storage limits. Current pricing and tier descriptions are available at remembermeforward.com/pricing and may be updated from time to time with notice to existing subscribers.

5.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected) in advance. By providing payment information and subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

5.3 Free Trial

We may offer free trials of paid subscription features. At the end of a free trial, your account will automatically convert to the selected paid tier unless you cancel before the trial ends.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features through the end of the period for which you have already paid. We do not provide prorated refunds for partial billing periods except where required by applicable law.

5.5 Refunds

Refund requests may be submitted to support@remembermeforward.com within 14 days of an initial subscription charge or renewal. Refunds are granted at our discretion and are not guaranteed for partial-period cancellations. We reserve the right to deny refunds for accounts found to be in violation of these Terms.

5.6 Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice to existing subscribers before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. User Content and Data Ownership

6.1 Your Content

You retain full ownership of all photos, videos, text, documents, voice recordings, and other materials you upload, create, or store on the Service ("User Content"). Remember Me Forward does not claim ownership of your User Content.

6.2 License to Remember Me Forward

By uploading or submitting User Content, you grant Remember Me Forward LLC a limited, non-exclusive, royalty-free, worldwide license to store, process, and display your User Content solely as necessary to provide and improve the Service. This license does not grant us the right to sell, license, or publicly distribute your User Content to third parties.

6.3 Content Responsibility

You are solely responsible for the User Content you submit. You represent and warrant that:

  • You own or have the necessary rights to the content you upload
  • Your content does not infringe any third-party intellectual property, privacy, or other rights
  • Your content does not violate any applicable law
  • You have obtained any necessary consents to upload photos, videos, or information about other individuals

6.4 Content Shared Within Family Groups

When you share memories, photos, or other content within a family group, you grant other members of that group access to view that content as configured by the group's sharing settings. You retain ownership of your content and may remove shared content at any time, subject to any applicable retention policies disclosed to you at the time of sharing.

6.5 Data Portability

You may request an export of your User Content at any time by contacting support@remembermeforward.com. We will provide your content in a standard format within a reasonable time.

6.6 Exporting your data

You can request a copy of your content from Settings, under Privacy. The export includes your own content and the shared family content you can access in your family groups, such as photos, videos, written memories, and your family tree. Shared items name the uploader where the record has one.

An export is available for 7 days, then deleted. You can request one export every 7 days.

If you receive an export, you are responsible for keeping it private and for respecting the privacy of the relatives whose content it contains.

7. Legacy Vault — Special Terms

The Legacy Vault is a unique feature that allows you to store content intended for delivery to designated recipients at a future date, upon a specific condition (such as reaching a certain age), or upon your passing. The following special terms apply to Legacy Vault content:

7.1 Vault Content

Legacy Vault items are stored securely and are accessible to you at any time during your account's active status. You may add, modify, or delete vault items at any time.

7.2 Designated Recipients

You may designate specific individuals as Legacy Vault recipients. Recipients must hold active Remember Me Forward accounts and must confirm their relationship to you through the platform's confirmed relationship process. You are responsible for keeping your recipient designations current and accurate.

7.3 Delivery Conditions

Vault content delivery is based on conditions you set within the platform, which may include a specific date, an age milestone, or upon reporting of your passing by a trusted contact. Remember Me Forward does not independently verify death or other triggering events. Delivery of vault content is based solely on information provided through the platform.

Important: Remember Me Forward is not a legally recognized estate planning tool. Legacy Vault content does not constitute a legal will, trust, or other testamentary instrument. We strongly recommend consulting a licensed estate planning attorney for legally enforceable arrangements.

7.4 Account Lapse and Vault Preservation

If your subscription lapses or your account is deactivated, access to vault content may be restricted. We will make reasonable efforts to notify designated recipients of account closure. See Section 11 (Account Termination) for details on data retention following account closure.

7.5 Recipient Filtering

You may configure vault delivery to specific recipient groups (e.g., all descendants, children only). You acknowledge that recipient eligibility is determined by the confirmed relationship data within the platform and that RMF is not responsible for disputes among family members regarding vault access.

7.6 No Guarantee of Delivery

While we use commercially reasonable efforts to maintain vault content and facilitate delivery, Remember Me Forward does not guarantee delivery of vault content in all circumstances, including but not limited to extended platform unavailability, failure to maintain valid recipient accounts, or technical errors. We recommend maintaining backup copies of important documents outside of the platform.

8. Family Groups and Shared Access

The Service allows users to create and join family groups for the purpose of sharing memories and building a shared family history. By joining a family group, you agree that:

  • Group administrators may configure which content is shared within the group
  • Content shared within a group may be viewed by all current and future members of that group, unless sharing settings are changed
  • You may leave a family group at any time through your account settings
  • Content you have shared within a group may remain accessible to other group members after you leave, at the discretion of the group administrator, unless you request deletion of your shared content

Remember Me Forward is not responsible for disputes between family group members regarding access to or ownership of shared memories.

9. Prohibited Conduct

You agree not to use the Service to:

  • Upload, share, or store content that is unlawful, defamatory, harassing, abusive, obscene, or otherwise objectionable
  • Infringe the intellectual property rights of any third party
  • Upload content depicting or exploiting minors in any sexual or inappropriate manner
  • Impersonate another person or create a false identity
  • Attempt to gain unauthorized access to other users' accounts or vault content
  • Use the Service to transmit spam, phishing attempts, or malicious software
  • Scrape, harvest, or collect user data from the platform without authorization
  • Use the Service to store or transmit content that violates applicable export control or sanctions laws
  • Attempt to reverse-engineer or circumvent any security features of the platform
  • Use automated tools to access the Service except as expressly permitted by us

Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.

10. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all other content created by Remember Me Forward (collectively, "RMF Content"), is the property of Remember Me Forward LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Remember Me Forward" and the Remember Me Forward logo are trademarks of Remember Me Forward LLC, with a trademark application pending before the United States Patent and Trademark Office. You may not use our trademarks without our prior written consent.

Nothing in these Terms grants you any right to use RMF Content other than as necessary to use the Service as intended.

11. Account Termination and Data Retention

11.1 Termination by You

You may close your account at any time by contacting support@remembermeforward.com or through your account settings. Upon account closure, your personal memories and profile data will be scheduled for deletion within 90 days, unless a longer retention period is required by law.

11.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Conduct that we reasonably believe poses a risk to other users or to the platform
  • Prolonged inactivity (accounts inactive for more than 24 consecutive months on a free tier)
  • Failure to pay subscription fees

11.3 Effect of Termination

Upon account termination, your right to access the Service ceases immediately. We will retain your data for a period of 90 days following termination to allow for account recovery requests, after which your data will be permanently deleted, subject to legal retention requirements.

11.4 Vault Content After Account Closure

If your account is closed and you have configured Legacy Vault recipients, we will make reasonable efforts to deliver queued vault items to designated recipients during the 90-day retention period. After this period, undelivered vault content will be permanently deleted.

11.5 Survival

Sections 6 (User Content and Data Ownership), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), and 14 (Dispute Resolution) survive termination of these Terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or available at all times
  • Any data stored on the Service will be free from loss, corruption, or unauthorized access
  • The Service will meet your specific requirements

Remember Me Forward is not a data backup service. You are encouraged to maintain independent copies of important content.

Legacy Vault: Remember Me Forward does not guarantee the legal enforceability of vault content as a testamentary instrument in any jurisdiction. Vault features are provided as a personal communication and memory preservation tool only.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REMEMBER ME FORWARD LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CONTENT, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the United States and the State of Maryland, without regard to conflict of law principles. Remember Me Forward LLC is based in and operates from the State of Maryland. Subject to Section 14.3 (Arbitration), any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of such courts. Nothing in this Section 14.1 is intended to limit any right you may have under the Maryland Consumer Protection Act (Md. Code, Com. Law § 13-101 et seq.) or other applicable Maryland consumer protection laws that cannot be waived by agreement.

14.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at legal@remembermeforward.com and attempt to resolve the dispute informally for at least 30 days.

14.3 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Remember Me Forward agree to waive any right to a jury trial and to participate in any class action lawsuit or class-wide arbitration.

14.4 Exception

Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
